Axarquía Home Watch & Property Care

1. Definitions

Axarquía Home Watch & Property Care (“the Company”) provides Home Watch and Property Care services to property owners (“the Client”). Home Watch consists of non-invasive, visual inspections and reporting only.

2. Scope of Services

The Company provides scheduled inspections of the Client’s property for the purpose of observing and reporting visible issues such as leaks, damage, or irregularities. Services do not include repairs, technical maintenance, security services, or insurance coverage unless explicitly agreed in writing.

3. No Guarantee

The Company does not guarantee the prevention of damage, loss, theft, vandalism, or other incidents. Home Watch services reduce risk through regular oversight but cannot eliminate all risks associated with property ownership.

4. Liability

The Company and its representatives shall not be held liable for:

Damage, loss, or theft occurring during or between inspection visits

Burglary, vandalism, or criminal acts

Damage caused by third parties, contractors, neighbors, or utility providers

Damage caused by weather conditions, natural events, or force majeure

Liability is limited to intentional misconduct or gross negligence, where legally applicable.

5. Third Parties and Contractors

If requested, the Company may assist in contacting or supervising third-party contractors. The Company is not responsible for the work, performance, pricing, or outcomes of third parties.

6. Emergency Situations

In the event of an emergency that may cause further damage to the property, the Company may take reasonable action to limit damage. Any costs incurred will be the responsibility of the Client.

7. Access and Keys

The Client is responsible for providing safe and legal access to the property. All keys and access information will be handled with care and discretion.

8. Reports and Communication

Inspection reports will be provided after each visit. Reports reflect observations at the time of inspection only and do not constitute a professional or technical assessment.

9. Insurance

The Client remains fully responsible for maintaining appropriate insurance coverage for the property at all times.

10. Termination

Either party may terminate the agreement with written notice, subject to any agreed notice period.

11. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with Spanish law.

By engaging the services of Axarquía Home Watch & Property Care, the Client acknowledges and agrees to these Terms and Conditions.
